Not too good with conformity of workers rights in Poland

Amendment of polish law of work favourable for the employers that was enforced in 2003 paramountly changed the situation of trade unions in Poland - International Confederation of Free Trade Unions estimates.

According to the report of the confederation in consequence of a change in safety of road traffic law a right to strike has been limited. "An organization of a legal demonstration by trade unions is now almost impossible" - it was written in the document.

 

The report shows some examples of breaking the trade unions' rights in 134 countries. As it claims, within last year 129 trade unions' activists were murdered all over the world and thousands were imprisoned. All over the world the workers rights are broken.

According to ICFTU in Europe workers rights are mostly broken outside the European Union. 9 out of 10 new member contries of EU have problems with the conformity of workers rights, including Poland. Amongst new EU members only Slovenia isn't noticed in the report of ICFTU. But there are Germany, Belgium, Great Britain and Spain.

ICFTU estimated that the amendment of polish code of work resolved in 2002 and announced in 2003 weakens the trade unions' rights in Poland. It was giving eg. a right to multiple employing workers for undetermined time what according to ICFTU for sure doesn't encourage to engage with the trade union's activities. Some changes weakening the protection of trade union's leaders were noticed and also a limitation of a right to trade unions' activity for civil service workers.

"The government made an amendment of the law about road traffic introducing a clauses that almost make it impossible for trade unions to organize a legal demonstration. The law was changed without the consultations with ze unions. Organizers of the demonstrations are obliged to assure medical help and fire-fighting equipment(�) They also have to make a plan of road traffic organization. Moreover the demonstration have to be announced to the authorities 30 days before" - it was written in the report.

There was also an information that polish trade unions complain about the discrimination of private sector workers who try to organize trade unions' activity and the law doesn't fully prevent the discrimination.

The most serious examples are dissmissals, changes of contracts or moving the trade unions' activists to other positions. Employers very often ignore the profitable for the unionists court judgements.

Employers often don't comply the right to strike and demand workers to sign up the declarations saying that they won't take part in the strike. Moreover, long and complicated procedures of strike cause that a lot of actions are illegal. As a result of that the striking people are liable for losing the social services and the trade unions for paying damages - report says.
The Institute also criticizes the practices of workers' self-hiring - those people are out of the collective orders. Not paying the rewards is also a problem.
